CHOSNN, LLC offers each item of property (a “item” or “items” or “lot” or “lots”) for sale at auction subject to and under these Auction Terms of Sale as may be amended from time to time (“Agreement”). In this Agreement, “we,” “us,” “our,” “CHOSNN”, a State of Iowa limited liability company; and “you,” “your,” “buyer,” “bidder”, “purchaser” or similar terms mean the individual or entity bidding on or buying an item/lot from CHOSNN at auction, via the Internet or other means (and you and CHOSNN will sometimes be called a “Party” and together “Parties”). This Agreement contains mandatory arbitration dispute resolution. WELCOME TO CHOSNN Section 1. AGREEMENT. By registering to bid, bidding, or otherwise purchasing an item/lot from CHOSNN, you hereby enter into and agree to be bound by and to comply with, the terms of this Agreement. This Agreement governs the relationship between you, as a bidder and/or buyer, and CHOSNN, the seller. Your Bid Is an Offer. Any bid you submit at www.CHOSNN.com constitutes an offer to buy the item/lot for the amount of your bid. Your bid is subject to the terms of this Agreement. If your bid is accepted, you become contractually bound to purchase the item/lot for which you bid, in accordance with the description of that bid and this Agreement. All Sales Are Final. An item/lot is not returnable. You are advised to examine the pictures of the item/lot prior to placing a bid. By bidding on an item/lot, you hereby agree and affirm that you have examined the condition through pictures, videos, or documentation of the item/lot and have no objections to the item’s/lot’s condition as displayed. All sales are final. Privacy And Security. We endeavor to protect your personal information at all times. Our website meets the highest security standard available provided through a third-party web host. Protection of your personal information is in line with our privacy policy found at http://www.CHOSNN.com/privacy. REGISTRATION Section 2. To bid for an auction held by CHOSNN at www.CHOSNN.com, you must create an account with us and register for the auction scheduled for that item/lot. Once you established an account with CHOSNN, you simply need to just register for each future auction in which you plan to place a bid. You may register for and participate in any auction as soon as the auction goes live on www.CHOSNN.com. VERIFICATION Section 3. Verification of Your Identity. We need to confirm the identification of customers that intend to bid in our auctions. We require that you verify your identity and contact information including your address by providing us or the third-party service provider with a copy of your government issued photo identification. Verification Process. The Verification process may be handled by third party service providers that specialize in the verification of identification and addresses. Please note that the information you share with us or the third-party is subject to the third-party verification processor’s terms, conditions, and privacy policies. CHOSNN is not a part of, or is responsible for, the actions or failures to act of, the verification processors. Section 4. AUCTIONS All auction items/lots are sold “AS IS” “WHERE IS” with no guarantees. CHOSNN strives to describe the item/lot as best as possible. You are responsible for reviewing all the pictures; you are responsible for asking questions; you are responsible for seeking additional information; you are responsible for all bids placed by your device from your registered account at CHOSNN.com. Timed Auctions. CHOSNN only conducts timed auctions. In a timed auction, you can also participate by increasing your bid and watch the bidding in real time – but only online. The auction application that we use accepts bids and proclaims a Winning Bid and said Winner will be notified through email or telephone. Our Role As Auctioneer. CHOSNN serves as the auctioneer. We set and execute the standards and conduct of our auctions including without limitation, whether, when and/or if to advance the bidding, to reject any bid offered, to withdraw any item/lot, to reoffer and resell any item/ lot, and to resolve any dispute in connection with a sale. CHOSNN reserves the right to withdraw an item/lot from auction for any reason and with no liability. CHOSNN has complete authority to make decisions regarding the sale, and our rulings on any disputes or issues that arise during the auction will be considered final and binding on all other participants in such a sale. Our Record of the Sale. CHOSNN records constitute the factual, accurate record of all transactions and govern discrepancy related to the sale or auction of an item/lot. Buyer’s Premium. Buyer’s Premium is the amount added to the hammer price and paid as part of the total purchase price. CHOSNN charges a Buyer’s Premium of 13%. By bidding in our auctions, you agree to pay Buyer’s Premium of 13% and any shipping and applicable taxes.
